1. Acceptance of Terms

Welcome to Cliks (the "App," "Service," "we," "us," or "our"). By downloading, accessing, or using the Cliks mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Cliks. We reserve the right to modify these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

Cliks is a digital wardrobe management application that allows users to:

• Photograph and catalog their clothing items
• Create and manage digital outfits
• Use AI-powered features to analyze clothing items
• Access virtual try-on functionality using AI image generation
• Organize and categorize their digital closet
• Generate outfit recommendations

The Service utilizes artificial intelligence and machine learning technologies to provide enhanced functionality, including image analysis, background removal, and virtual try-on features.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18 years of age, you must have permission from a parent or legal guardian to use the App. By using the Service, you represent and warrant that:

• You meet the age requirements
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

4. User Accounts

4.1 Account Creation

To access certain features of the App, you must create an account. You may register using:

• Apple Sign-In
• Email and password

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

4.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

5. Subscription and Payment

5.1 Free and Premium Features

Cliks offers both free and premium subscription tiers. Premium features are accessed through in-app purchases managed by RevenueCat and processed through Apple's App Store or Google Play Store.

5.2 Subscription Terms

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Subscriptions may be managed and auto-renewal may be turned off in your device's account settings
• No refunds will be provided for unused portions of a subscription period

6. User Content

6.1 Your Content

You retain all rights to the content you upload, including photographs of clothing items, personal photos for virtual try-on, and outfit combinations ("User Content").

6.2 License to Us

By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, process, and display your User Content
• Use your User Content to provide and improve the Service
• Process your images through our AI partners (OpenAI, FAL.AI) to provide App features
• Create derivative works (such as background-removed images and virtual try-on results)

This license exists only for the purpose of operating and improving the Service.

7. AI-Powered Features

7.1 Image Analysis

Our clothing item analysis feature uses OpenAI's GPT-4 technology to identify clothing types and categories, detect colors, and generate item descriptions. Results are AI-generated and may not always be completely accurate.

7.2 Virtual Try-On

Our virtual try-on feature uses FAL.AI's Nano Banana technology to generate images showing you wearing selected clothing items or outfits. You acknowledge that:

• Generated images are AI-created representations and may not be perfectly realistic
• Results depend on the quality of input photos
• Generated images are for personal use and entertainment purposes only
• We are not responsible for the accuracy or quality of generated images

8. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated tools (bots, scripts) to access the Service
• Reverse engineer, decompile, or disassemble any part of the App
• Remove, circumvent, or disable any security features or restrictions
• Impersonate others or provide false information
• Collect or harvest information about other users
• Use the Service to spam, phish, or distribute malware
• Resell or commercially exploit any part of the Service
• Use the Service in any way that could damage our reputation

9. Intellectual Property

The Service, including its design, features, text, graphics, user interface, and software, is owned by Cliks and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes, subject to these Terms.

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our Privacy Policy.

11. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SECURITY.

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Results from AI features will be accurate or reliable
• Defects will be corrected
• The Service is free from viruses or harmful components

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Account Termination

You may terminate your account at any time by using the account deletion feature in the App settings or contacting our support team. Upon termination, your User Content and account data will be permanently deleted within a reasonable timeframe.

We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent or illegal activities, or if we determine that termination is necessary.
